1. THE QUALIFIED BIDDER
1.1 Juristic or ordinary person of either local or foreign nationality.
1.2 Must be 18 years of age and above.
2. THE AUCTIONEER
2.1 The Auctioneer will designate the method for bidding.
2.2 The Auctioneer will designate the time and place for bidding.
2.3 The Auctioneer will designate the machines for bidding.

4. TERMS OF BIDDING
4.1 All participants must register with JSSR AUCTION prior to bidding. The Auctioneer shall be examining for qualifications according to the Auctioneer's own criteria.
4.2 The participants must accept the Terms and Conditions herein before registering to become a Bidder.
4.3 All participants are required to place a refundable security deposit upon registration. (see point 7).
4.4 Bidder number, Username and Password .
(a) The Bidder will be notified within two (2) working days after the Security Deposit has been confirmed upon receiving. The Auctioneer under its sole discretion will issue and notify the BIDDER'S number, username and password by e-mail. In case the Bidder doesn't receive such confirmation e-mail, the Bidder MUST CONTACT THE AUCTIONEER AT +662-704-9555 or e-mail to [email protected]
(b) The Bidder shall be fully responsible for his/her own BIDDER'S number, username and password.
(c) The Auctioneer reserves the rights to cancel the Bidder’s account at any cause and any given time before, during or after the Auction without giving prior notice.
4.5 Change of Registration Information .The Bidder must contact the Auctioneer for any changes on information (such as name, address, contact,bank account details, etc.) used for registration by fax +662-704-9552 or e-mail to [email protected]
4.6 The Successful Bidder can neither cancel nor change their biddings/items.
4.7 Registration could be done at the site office or by hotline +66-63-838-5111 or LINE: @jssrauction 3 days before the auction or on the auction day itself. Bidders are free to inspect all the equipment/items put up for sale within 2 days before each auction.
4.8 The successful Bidder must make the full payment within seven (7) days after the auction event. In case of delay payment, the successful Bidder shall be charged of interest on the relevant invoice amount at the rate of 15% per year.
5. INSPECTION OF EQUIPMENT/ITEMS
Bidders are free to inspect all the equipment/items put up for sale within 2 days before commencement of each auction from 8:00 a.m. – 5:00p.m., at the auction sites K.M.35. The Auctioneer does not warrant or guarantee the accuracy in the description of the equipment imprinted on the bidding card, catalogue list or as shown in the website: http://www.jssr.co.th
6. REGISTRATION PROCEDURE AND REQUIREMENTS
6.1 Potential auction participants (Bidders) must inform the Auctioneer of their intention, together with presentation of the following documents;
6.1.1 Ordinary individuals are required to present their personal identity card and house registration completed with signatures. Foreign individuals must submit a valid passport upon registration.
6.1.2 Corporate persons must provide copies of company affidavit that is issued by the Ministry of Commerce complete with any one of the authorized officer’s signature and company’s stamp endorsement. The document is only deemed valid if the issuing date falls within 3 calendar months from the date of submission.
6.1.3 Power of Attorney; Provide the Power of Attorney form and copies of personal identity cards of both the attorney and the grantor.
6.2 All potential participants must place the refundable security deposit to be successfully registered to proceed on to bid in the auction.
- Minimum deposit 50,000 THB (for bidding at both KM35)
The bidder can bid up to 5 times the amount of the deposit.
Example, bidder deposit of 50,000 THB allows bidder to bid up to 250,000 THB (Once the bidding amount is over 250,000 THB, the bidder will not be allowed to make bids and additional deposit must be placed to continue bidding.)
- Deposit starting from 200,000 THB (for bidding at both KM35)
The bidder can bid up to 10 times the amount of the deposit.

6.2.2 Locals can register and place security deposit at K.M. 35 auction site in cash, cashier cheque, bank drafts or T/T. For a foreign register, security deposit can be paid in cash or by T/T. Oversea telegraphic transfers are to be made to Kasikorn Bank only.

NOTE : Please FAX or e-mail copy of the "Remittance Certificate/SLIP" or the "Application for Remittance with the Bank Receipt" with your (company) name by fax to +662-704-9504. Deposits will be refunded after the auction, no later than 3 working days, for those who have registered but made no purchase at the Auction (T/T bank fee are charged to the bidder but the auctioneer will not charge any fee for registration). The deposit will be considered as part payment for items sold to the successful bidder who will need to make full payment within seven (7) days after the auction event.
7. BIDDER’S RIGHTS AND RESPONSIBILITIES
7.1 Bidder’s Right .The Bidder can bid on every items listed by JSSR AUCTION only.
7.2 Bidder’s Responsibilities. The Bidder shall comply to any terms and conditions herein and/or any rules, regulations, terms and conditions related and stated by the Auctioneer. The Bidder must accept all the transactions conducted at JSSR AUCTION.
7.3 Prohibited Activities . The Bidder must accept all damages, losses, penalty, interest and expenses incurred, if the Bidder commits one or more of the following actions:
(a) Any intentional or unintentional act causing signal disturbances to JSSR AUCTION online system.
(b) Violation of JSSR AUCTION Terms and Conditions.
(c) Violation of law, ordinance, rules or other regulations of the Kingdom of Thailand.
8. Price and Expenses
8.1 All transactions shall be made in Thai BAHT. The auction price indicated does not include VAT, Thailand import duty, customs clearance, transportation cost and other expenses.
8.2 The auction price is based on "EX-YARD” basis.
8.3 Additional Expenses, such as FOB charge, transportation cost, recondition, re-painting, special washing, dismantle or assembly can be arranged by the Auctioneer upon request by the Successful Bidder and at the Bidder’s own expense.However, payment for the item(s) sold at the Auction must be fully paid before such additional expenses incurred.
9. PAYMENT
The Successful Bidder must be FULLY responsible for every transaction done by the Bidder’s account.
9.1 The Performa Invoice will be issued and sent by the Auctioneer, the Bidder must make the full payment within seven (7) days after the auction event. The payment can be made by cash at the JSSR Auction Free Zone office (K.M.35),Thailand, or by remittance to the bank account and notify the Auctioneer as stated in (7.2.4) prior to delivery. The auction price will be quoted in Thai Baht, if the Bidder wishes to make the payment in USD or JPY; the amount must be equivalent to the Thai Baht quoted in the pay slip.
9.2 In case of delay payment, the Successful Bidder shall be charged of interest on the relevant invoice amount at the rate of 15% per year.
9.3 In case of payment failure by the Successful Bidder, the Auctioneer can forfeit the security deposit as a penalty and impose charges in (10.2) on that Bidder. In addition, the Successful Bidder is liable for any damages including but not limited to the loss of opportunity for sales, compensations and other expenses. The Auctioneer will reserve the rights to resell the purchased item without any notification to the Successful bidder. The Successful bidder must be responsible for the remaining amount, if the resell amount is not enough to cover all liabilities.
10. RECEIPT/TAX INVOICE
JSSR AUCTION CO., LTD will issue receipt /tax invoice according to the registered name and address. There will be no changes to the information on the receipt/tax invoice after it has been issued.
11. METHODS OF PAYMENT
11.1 Transfer through bank using the PAY IN slip issued by JSSR AUCTION CO.,LTD.
11.2 Settlement of payment either by cash or bank draft or cashier cheque is to be done at JSSR Headquarter (K.M.35) ONLY. Pick up your item(s) from the site (either K.M.35) that it was being auctioned at.

* The auctioned price does not include remittance fee
* The Bidders are responsible for their own remittance fee
* Successful bidders must make full payment within 7 days after the auction date, otherwise the sale would be terminated and the deposit subjected to forfeiture.
12. BUYER’SCOMMISSION RATE
Successful Bidders will be charged commission fees by the Auctioneers on each “sold” item at the following rates;

13. EQUIPMENT REMOVAL & TRANSPORTATION FROM K.M.32 SITE (After auction event)
13.1 For delivery efficiency, full payment must be made within 7 days after the auction event and at least a day before picking up the equipment. After making the payment, please fax the remittance-related document together with your Bidder No. to +66-2-704-9504. Also, contact the Auctioneer for confirmation at +66-84-075-2927 or +66-2-704-9548.
13.2 The Auctioneer will hand the equipment and all other necessary supporting documents to the successful bidder when the full payment is made within 7 days after the Auction event. (Payment in foreign currency; the amount must be equivalent to the price sold in Thai Baht).
13.3 All transportation costs, dismantling costs and any other related expenses incurred from equipment removal process will be charged to the account of the successful bidder.
13.4 All fully paid (including all taxes) equipment must be removed from the auction site K.M.35 within 14 days after the auction event. Otherwise, the successful bidder will be liable to pay the Auctioneer a storage fee of 500 Thai Baht per day per unit of equipment left in the Auctioneer’s premise for each day exceeding the deadline.
NOTICE: In instances where successful bidders authorized any other party to remove their equipment from auction site, the authorized party will be required to produce Letter of Authorization together with company’s stamp or signed by an authorized personnel and personal identity card or passport of the Successful Bidder and the authorized party.
13.5 The Successful bidder must provide their own mode of transportation in removing the equipment out of the Auction site. The Auctioneer will provide free-of-charge assistance in loading the equipment/items onto trucks onsite (except dismantling or re-assembling processes). However, the Auctioneer will NOT be responsible for any accidents or damages that may occur during the assistance.
13.6 The Auctioneer will provide all documents the Auctioneer holds to the bidder within 30 days after the auction day. The auctioneer only guarantees that all documents will be legally valid or 30 days after the successful bidder receives the documents. The auctioneer will not be responsible for validity of equipment documentation after 60 days from the auction event date.
13.7 Every item on the auction is sold on "AS IS WHERE IS” basis. JSSR Auction Co., Ltd will act as the exporter should there be any oversea export.
14. EQUIPMENT REMOVAL & TRANSPORTATION FROM K.M.35 SITE (Free Zone)
JSSR Auction Free Zone in Thailand is authorized and proceed under the supervision of the Royal Thai Customs for that goods in the DFZ is exempted from duties (Import Tax, Excise Tax and Value Added Tax), and duties are payable only when imported to Thailand. Goods from DFZ are treated as import into the kingdom or import completed when taking out from the DFZ into the kingdom.
14.1 Full payment must be made within 7 days after the auction event and at least a day before picking up the equipment. After making the payment, please fax the remittance-related document together with your Bidder No. to +66-2-704-9504. Also, contact the Auctioneer for confirmation at +66-84-075-2927 or +66-2-704-9548
14.2 The successful bidder must be responsible for all cost and procedure in transportation (land and sea) of all equipment from the auction yard. If the successful bidder wish to import the equipment to Thailand the bidder must be responsible for all cost and procedure for when importing to Thailand including all taxes. JSSR Auction Free Zone in Thailand is authorized and proceed under the supervision of the Royal Thai Customs for that goods in the DFZ is exempted from all duties (Import Tax, Excise Tax and Value Added Tax), and Tax is payable only when imported to Thailand. Goods from DFZ are treated as import into the kingdom or import completed when taking out from the DFZ into the kingdom.
14.3 If the Successful Bidder has the intention of exporting the equipment out of the Free Zone, Thailand, to other countries, the Successful Bidder shall be responsible for all cost and procedure in transportation (land and sea) of all equipment from the auction yard.
14.4 JSSR Auction Co., Ltd provides import-export service at a certain fee charges.
14.5 All fully paid (including all taxes) equipment must be removed from the auction site within 14 days after the auction event. Otherwise, the successful bidder will be liable to pay the Auctioneer a storage fee of 500 Thai Baht per day per unit of equipment left in the Auctioneer’s premise for each day exceeding the deadline.
14.6 All fully-paid equipment must be removed from the auction yard within 14 days after the auction and not more than 60days. If the paid-for equipment has not been removed within 14 days, the Auctioneer charges the Successful Bidder as stated in (14.7). Once it exceeds 60 days the Auctioneer reserves the right to put that equipment up for sales again at the next auction or send it to other auction as to cover for overdue storage fees, handling fees and other fees incurred from repeat-auction of the equipment.The remaining will be returned to the Successful Bidder; however, if the revenue does not cover all charges, the Auctioneer reserves the right to impose the remaining charges on the Successful Bidder.
The Bidder shall be requested by the Auctioneer to pay a security deposit of 4 times on C.I.F Price on Invoice (Importing document) before removing (exclude the purchased item amount), the purchased item shall be removed out of Thailand within 60 days. The Security Deposit shall be refunded within 7 days after the status of the purchased item at Thai Customs has been changed to exported. Unless the equipment is exported within the limited time, the Auctioneer can forfeit the security deposit to cover any expense incur for exporting process.

Certain requirements may have to be met before the equipment maybe imported or exported. Compliance with such requirements is the sole responsibility of the Purchaser. The Auctioneer does not provide safety certificates, certificates of origin and the like. Payment of export or other duties, if applicable, is the sole responsibility of the Purchaser of the equipment. For the Auction Site that is a Free Zone Area, the purchaser of equipment must obtain the required customs documents to remove the equipment from the Auction Site at their own account. Custom broker approved by the Auctioneer is available at the Auction Site to assist the Purchasers therewith at Purchaser’s cost.
15. LIMITATION OF LIABILITY
15.1 The Auctioneer shall not be liable for any losses and / or damages of the Bidder caused by such matters as cancellation, discontinuance and/or termination of the Auction due to any unavoidable circumstances including but not limited to such reasons as the failure of the computer system or any reasons whatsoever that unable the Auctioneer to connect to the websites in the event of bidding or other information channeling.
15.2 The Auctioneer shall not be liable to indemnify against all manner of claims, demands, actions, suits and proceedings of whatever nature whensoever and by whomsoever made or instituted and also against all manner of damages, losses, penalty, interest and expenses, whether directly or indirectly, whensoever incurred in connection with incidental to or arising out of the acts or omissions or negligence of the Auctioneer, his representatives, agents, servants, employee or contractors for the Auction or any other reasons related to the Auction.
16. TERMINATION
The Auctioneer at its sole discretion may announce the cancellation of the Auction at any reasons and any time. The Auctioneer may terminate the Bidder without giving prior notice, in any of the following events without any objections from the Bidder.
16.1 When the Bidder fails to make full payment within the given time.
16.2 When the Bidder files a petition for seizure, provisional seizure, interim order, bankruptcy procedure, corporate rehabilitation procedure, corporate reorganization procedure or other similar procedures, or such petition is filed against the Bidder.
16.3 When the bill issued by the Bidder is dishonored or the Bidder becomes subject to suspension of bank transaction.
16.4 When the Bidder violates and/or does not conform to any terms and conditions herein and/or rules and regulations stated by the Auctioneer.
16.5 Whenever the Auctioneer, at its sole discretion, deems necessary for the purpose of managing JSSR AUCTION.
17. OTHER GENERAL TERMS AND CONDITIONS
17.1 Ownership and Risk. Ownership and risk of purchased equipment/items shall be passed to the Successful Bidder once the Auctioneer notifies confirmation.
17.2 No assignment of rights . The Successful Bidder must not assign any of its rights and/or obligations herein.
17.3 Accuracy of stock list description. All information from the list is prepared only as a guide. The Auctioneer bears no responsibility regarding the discrepancies between the listing and the item.
17.4 Security trade control. The Auctioneer reserves the rights to cancel at its sole discretion, if there is a reason to believe that the sale of any items will be a risk in violation to the law of Thailand
17.5 Auctioneer’s Discretion .The Bidder is not in the power to make any objections at any reasons to the Auctioneer’s discretion and make no claim for any damages including but not limited to compensation, cost and/or expense incurred.
17.6 Amendment and Modification. Terms and Conditions and/or documents and/or the Auction List of JSSR AUCTION may be changed, amended, added and/or cancelled at any time and any reasons, without prior notice to the Bidder and the Bidder shall be bound on the Amendment and Modification.
17.7 Settlement of Dispute Any dispute, controversy and/or difference between the Bidder and the Auctioneer arising from or in connection with the Terms and Conditions of JSSR AUCTION, shall be settled by jurisdiction of Thailand.
17.8 Contradiction or Confliction . Any other terms and conditions related to the Auction shall be deemed to be an integral part of this Terms and Conditions herein and if there are any provisions in the Terms and Conditions herein that are contrary to or in conflict with any provision of other terms and conditions related to the Auction, the most recent documents shall prevail.
17.9 Interpretation and Governing Law. All Headings in this Terms and Conditions serve for reference purposes and reading convenience and in no way be affected in the construction or interpretation of any provision of, or the rights or obligations under such section of this Terms and Conditions. The Interpretation of Terms and Conditions and/or all documents related shall be governed in all aspects by the laws of Thailand.
REMARK: If any terms and conditions herein become invalid or illegal or unenforceable in any way under any law, the validity and legality or enforceability of the remaining provisions thereof shall remain valid in all respects and shall be deemed to not in any way be affected or impaired thereby.
Proxy Bidding
JSSR Auction provides a service to customers who are unable to participate in the auction event in person or online. A Proxy Bid is sometimes called an ‘absentee bid’. When you place a Proxy Bid, JSSR Auction will bid on your behalf for your selected items, up to and including your specified price. The item would be sold to the highest bidder. Registration is required prior to bidding to become an eligible bidder.
Proxy Bid (Unreserved Auction)
During an unreserved auction event, after the first bid has been initiated by an onsite or online bidder, the Auctioneer would then bid on your behalf until the next bidding increment exceeds your specified price. You are the winner of the bidding item only when other bidders have stopped placing bids and you are the highest bidder.
Example, if you placed a proxy bid at 1,000,000 Baht and the bidding stopped at 950,000 Baht with you being the highest bidder, the item would be sold to you at 950,000 Baht, NOT 1,000,000 Baht.
